Hiring departments as well as foreign national employees are surprised to learn how much time it takes to process immigration based petition from beginning to end. There is no doubt that lengthy processing times impact on when the foreign national will be able to commence work or in losing work authorization. There are many facts that come into play when processing immigration petitions from their beginning to their adjudication.
As an example, on the part of the foreign national there is the requirement to collect and submit the necessary supporting evidence. The hiring department also needs to complete certain forms regarding the hiring of the foreign national which are essential to the petition. Moreover, IFSS has to examine the documentation submitted and complete, file and receive back the approval of other federal mandated forms in some instances as a prerequisite to the preparation and filing of the actual immigration petition with the United States Citizen and Immigration Service (USCIS). In addition, inconsistent processing times at U.S. federal and state agencies may prolong even more the processing time of the petitions. Accordingly, to assume that the immigration processes can be quickly concluded is not realistic.
In order to assist hiring departments and foreign national employees in calculating the estimated processing times and submission of the documentation to IFSS we have developed the chart below. The time estimates are calculated from the date
all the required documentation is received
by the IFSS's immigration specialist. Because these time estimates take into account U.S. federal and state agencies processing times averages, they are subject to change. Incomplete applications will be returned to the hiring department, and it will result in longer processing times. Note that other problems may arise during the process which may delay, beyond the estimated time, the processing of the petition.
For example, it is not uncommon to receive Requests for Evidence from USCIS which require a careful and well researched response in order to avoid a denial if possible. As a result, despite the times hereby estimated we recommend that you call IFSS at 862-1719 to start the immigration process as soon as possible.
